Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website located at www.santaselvesstl.com (the “Site”), operated by Santa’s Elves Holiday Lighting & Decor (“Company,” “we,” “us,” or “our”). By accessing or using the Site, requesting an estimate, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About Us and Our Services
The Company provides residential and commercial holiday lighting and decorating services — including roof-line lighting, tree and shrub lighting, wreath and garland installation, pathway and accent lighting, and installation, take-down, and decor for indoor Christmas trees — in the Saint Louis, Missouri metropolitan area. We have served the holiday lighting and decor market since 2012 and are licensed in Missouri and insured for general liability and workers’ compensation. The Site is provided to share information about our services, showcase our work, and allow you to request a consultation or estimate. Any actual installation, service, take-down, or related work is performed under a separate estimate or service agreement, and the terms of that agreement will govern the work itself.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Site or request services. By using the Site, you represent and warrant that you meet these requirements.
3. Estimates and Quotes
Requests submitted through the Site (for example, through our contact or estimate request form) are requests for information and do not create a contract for services. To prepare a quote, we may need an image of your home; if one cannot be obtained from publicly available sources, we may ask you to provide one. Roof-line and other estimates are based on factors such as linear footage, scope, and the products selected. Any pricing or estimate we provide is nonbinding until set out in a written estimate or service agreement accepted by both you and the Company, and may change based on site conditions, scope, materials, and other factors.
4. Service, Rental, and Payment
Our holiday lighting and decor is provided on a seasonal basis, and the lighting and decor materials are rented to you rather than sold. Unless your written estimate or service agreement states otherwise, your one-time seasonal fee includes materials, installation, in-season service calls, and take-down and storage of your lighting and decor. All lighting and decor materials remain the property of the Company. A minimum order amount may apply (for example, a perhome minimum), as stated in your estimate.
Invoices are generally sent upon completion of the installation, and payment is due at that time. Where offered, pre-payment and other discounts are applied only as described in your estimate. Payments may be made through a secure third-party payment link; we do not store full payment card numbers. Take-down generally occurs in January. You agree to pay all amounts due under your accepted estimate or service agreement in accordance with its terms.
5. Text Messaging (SMS)
By providing your mobile phone number to us — for example, through a form on the Site, by phone, by email, or in your service agreement — and opting in to receive text messages, you consent to receive text (SMS) messages from Santa’s Elves Holiday Lighting & Decor. Depending on your interactions with us, these messages may include:
- quote and invoice notifications;
- appointment confirmations and reminders;
- “on my way” messages when a team member is traveling to your property;
- scheduling and project updates;
- customer-service communications; and
- other messages related to your project or service.
Message frequency varies. Message and data rates may apply, depending on your mobile carrier and plan.

6. Promotions and Discounts
From time to time we offer discounts and promotions, such as a pre-payment discount, a discount for first responders and medical professionals, and a neighborhood or subdivision discount for qualifying groups of homes. Unless stated otherwise, discounts: (a) cannot be combined with other offers; (b) have no cash value and are non-transferable; (c) require qualifying conditions (such as a minimum number of participating homes or payment in full at acceptance); and (d) may be modified, limited, or discontinued at any time. The discounts that apply to you will be confirmed in your estimate.
7. Acceptable Use
You agree not to use the Site to:
- violate any applicable law or regulation;
- infringe the rights of the Company or any third party, including intellectual property and privacy rights;
- submit false, misleading, or fraudulent information;
- transmit any virus, malware, or other harmful code, or attempt to gain unauthorized access to the Site or its systems; or
- interfere with or disrupt the operation of the Site or the servers or networks used to make it available.
8. Intellectual Property
The Site and all of its content — including text, photographs, graphics, logos, the “Santa’s Elves” name and marks, page designs, and the selection and arrangement of content — are owned by the Company or its licensors and are protected by copyright, trademark, and other laws. You may view and use the Site for your personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission.
9. Your Submissions
If you submit information, photographs, reviews, or other content to us through the Site (“Submissions”), you represent that you have the right to do so, and you grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting our business. We are not obligated to use or retain any Submission. Please do not submit confidential information that you do not wish us to use.
10. Third-Party Links and Services
The Site may contain links to third-party websites or services (for example, social media pages, payment services, or scheduling tools) that we do not control. We are not responsible for the content, products, or practices of any third party. Your use of third-party websites and services is at your own risk and subject to their terms and policies.
11. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on the Site is complete or current. Information on the Site is provided for general informational purposes only and is not professional design, electrical, or safety advice. Photographs are illustrative; actual results vary based on each property, design choices, materials, and conditions. Customers are responsible for providing access to a working electrical receptacle; we are not responsible for outages or issues caused by the property’s electrical supply, by timers adjusted by the customer, or by weather. Warranties or service commitments (if any) applicable to installation work are stated only in your written estimate or service agreement.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.
To the fullest extent permitted by law, the Company’s total liability arising out of or relating to your use of the Site will not exceed one hundred U.S. dollars ($100). This section does not limit liability for matters that cannot be limited under applicable law. Liability relating to services performed for you is addressed in your written estimate or service agreement.
13. Indemnification
You agree to indemnify and hold harmless the Company and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your Submissions, or your violation of these Terms or applicable law.
14. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, including information collected through text messaging.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective Date” above. Changes are effective when posted. Your continued use of the Site after changes are posted means you accept the updated Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-oflaws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to the jurisdiction of those courts.
